Effective from: July 2025These Terms & Conditions govern the use of our website and the purchase of products from FamilySpaces Limited
("FamilySpaces", "we", "us", "our") via www.familyspaces.co.nz. By accessing our website or placing an order, you agree to these terms.
1. Acceptance of Terms
By using this website or purchasing from us, you agree to be bound by these Terms & Conditions. We may update them at any time by posting the revised version on our website. Continued use of the website or our services after changes are made indicates your acceptance.
To purchase from our online store, you must be at least 18 years of age and legally able to enter into binding agreements.
Purchases must be for personal or household use only. You must not purchase goods for resale without our prior written consent.
If you are ordering on behalf of a company or organisation, you confirm you are authorised to accept these terms on their behalf.
2. Availability & Supply
All orders are subject to stock availability. If an item becomes unavailable after you place an order, we will notify you as soon as possible and may offer an alternative or refund.
3. Pricing & Payment
All prices are in New Zealand Dollars (NZD) and include GST, unless stated otherwise. Prices exclude delivery charges, which are calculated and shown at checkout.
We reserve the right to change prices at any time.
An invoice will be emailed to the address you provide when placing your order. Please ensure your contact details are accurate.
We accept:
- Visa and MasterCard (processed securely via Payment Express)
- Bank transfer (payment instructions provided at checkout)
We do not store credit card details. All payments are processed using industry-standard security by PCI-compliant providers.
4. Shipping & Delivery
We deliver to New Zealand street addresses only. This includes rural.
We aim to dispatch your item within 2 working days of payment being received. You'll receive a tracking link once your order is shipped.
Estimated delivery time: 2-3 working days after dispatch.
Delivery Notes:
- We deliver to most locations across New Zealand.
- In some cases, remote, offshore islands or hard-to-access locations may require alternative delivery arrangements or may not be serviceable. If you're unsure, please contact us before placing your order.
- You will receive a tracking link via email once your order has been dispatched.
Damage or Delivery Issues:
- If the packaging appears damaged, do not sign for it.
- Notify FamilySpaces within 2 working days of receiving any damaged goods.
- Following proper delivery procedures helps ensure we can process claims with our freight provider.
5. Returns & Refunds
We comply with the Consumer Guarantees Act 1993 for all purchases intended for personal use.
Change of Mind Returns:
- We may consider returns if notified in writing within 5 working days of receipt.
- Items must be in original, unused, resalable condition with all packaging intact.
- We do not accept returns for custom-made, clearance, or altered items.
- Shipping costs are non-refundable, and return shipping is the buyer's responsibility.
Faulty Goods:
If your product is faulty, we will meet our legal obligations to repair, replace, or refund under the Consumer Guarantees Act.
6. Liability
If you purchase goods for business purposes, the Consumer Guarantees Act does not apply. To the fullest extent permitted by law:
- We exclude all warranties except those required by law.
- We are not liable for any loss, damage, or indirect costs resulting from the use of our products or website.
- Our maximum liability is limited to the value of the goods purchased.

We strive to ensure all information on our website is accurate. However, we do not guarantee the completeness or accuracy of all content and reserve the right to correct errors or update information at any time.

We collect your personal information to fulfil orders, provide customer service, and improve your experience.
We comply with the New Zealand Privacy Act 2020. You may request access to or correction of your personal data at any time.
We will not share your personal information with third parties except:
- As required to process your order (e.g. courier services)

You may opt out of promotional emails at any time. Transactional messages relating to your orders will still be sent.
9. Ownership of Goods
Ownership and risk in the goods pass to you once full payment has been received and delivery has occurred.
10. Force Majeure
We are not responsible for any delay or failure in performance due to events outside our reasonable control, including but not limited to natural disasters, pandemics, strikes, or transport delays.
11. Applicable Law & Jurisdiction
These Terms & Conditions are governed by New Zealand law. Any disputes will be subject to the non-exclusive jurisdiction of the New Zealand courts.
If any part of these terms is found invalid or unenforceable, the rest will remain in full force and effect.
